Federal Hearing on DOJ “Fast and Furious” Withheld Docs

A hearing has been set for tomorrow, July 8, in federal court regarding the attempt by the conservative watchdog group Judicial Watch to lift the indefinite stay regarding its longstanding Freedom of Information lawsuit in Fast and Furious.

Judicial Watch sued the Justice Department for failure to provide public documents that the Obama Administration also is withholding from Congress under executive privilege.

Judicial Watch's original Freedom of Information Act request is more than two years old. The Justice Department argues that all of the relevant materials should be withheld pending a decision in the lawsuit filed by the House Oversight committee in an attempt to obtain the same records.

"Sixteen months have passed since the Court first stayed the proceedings, and the House Committee litigation is no closer to resolution… no settlement has been reached, and Judge Jackson did not grant the Department’s motion to dismiss. It is now time for this Court to adjudicate the FOIA case before it," argues Judicial Watch in its latest brief to the court.

The hearing will be held at 4pm Tuesday in U.S. District Court in Washington DC.
