FISA Court starts firestorm by appointing conflicted, anti-Trump attorney to help oversee FBI fixes

On Friday, the FISA Court posted an order naming anti-Trump lawyer David Kris to โ€œassist the courtโ€ in assessing the FBIโ€™s response to the court-ordered cleanup of lapses and abuses identified by Department of Justice Inspector General (IG) Michael Horowitz.

In a report released last month, the IG found FBI officials violated rules, policies and law in their applications to wiretap former Trump volunteer Carter Page. Horowitz testified the FISA surveillance process needs to be fixed "from top to bottom."

To some, the appointment of Kris is as mysterious as why the FISA Court's judges failed to flag the FBI abuses on their own.

In social media posts, Kris has called Republican Congressman Devin Nunes โ€œa politicized, dishonest [Intelligence Community] overseer who attempts to mislead.โ€ He tweeted that Trump and his advisors should be โ€œworriedโ€ that the โ€œwalls are closing in on himโ€ regarding the Mueller probe. Kris also bought into the now-disproven conspiracy theory about Trump colluding with Russia and Putin. But even more importantly, since that time, Kris has advocated for President Trumpโ€™s removal.

Kris's vocal opinions on President Trump and politics present numerous, obvious conflicts of interest.

Regardless, however, America is now faced with a very stark choice: do we want to be a country in which elected officials can use their governmental power to attack political opponents? If not, itโ€™s pretty simple: Trump has to go. 5/5

In addition, Kris writes for the anti-Trump blog โ€œLawfareโ€ and called Lawfareโ€™s chief, Benjamin Wittes, โ€œincisive.โ€ Wittes is the man who wrote of the need for an โ€œinsurance policyโ€ against Trump prior to Trumpโ€™s election.

[O]ur democracy needs a health insurance policy...The courts have a few obvious advantages, starting with hundreds of independent judges of both parties whom Trump cannot remove from office and who donโ€™t have to face his supporters in forthcoming elections...The goal...will be to offer a systematic defense of the values the Coalition of All Democratic Forces holds in common and to have the ability to respond rapidly to actions that threaten those values: to forestall such actions in court as long as possible, to whittle them down, and to block those that can be blocked. The goal is to use the courts to render Trumpโ€™s antidemocratic instincts as ineffectual as possible.

Wittes is also a friend of ex-FBI Director James Comey who was referred for criminal charges for mishandling and leaking government information in his anti-Trump efforts. (The Justice Department passed up charges, with officials stating they didnโ€™t believe Comey meant any harm.)

IG Horowitz flagged 17 mistakes in the FBI's surveillance applications against Page and testified, "I think itโ€™s fair for people to โ€ฆ look at all these 17 events and wonder how it could be pure incompetence.โ€

Likewise, one could look at the FISA Courtโ€™s appointment of Kris to help fix thingsโ€ฆ and wonder whether it could be pure incompetence. 

The latest FISA Court action could be construed as a moment of chilling charity in the ongoing questions about how these abuses could have occurred, and the challenges with fixing them.

      Judge Boasburg signed the order to hire this lunatic. Boasburg was appointed to the FISA court by Chief Justice Roberts. He can't be trusted either to stand for the Constitution.

    It's frustrating and frightening to see the extent to which our political and judicial processes have been corrupted by liberal ideology. It's maddening that those in charge of the judicial process and the DOJ leadership think we don't incite their bias and conflicts of interest.

      NO THEY DONT. THE DNC AND HOLLY WOOD AND MOST OF THE AMERICA SYSTEM THINK'S THAT ALL AMERICANS ARE AS DUMP AS A ROCK. THEY THINK IF THEY SAY IT WE WILL BELIEVE IT. ON LINE A LOT.     The partisan credentials of the judge are unclear. He was appointed to be a Federal judge by President Barry, however.

    Get rid of FISA. They've been corrupt almost since their inception. Those judges would have to be "stuffed" for not catching the criminal applications proffered to them by Comey. They go, Kris goes too. Barr needs to take over and also re examine that clinton foundation fake investigation by Huber while he's at it. We're about 4 years into playing the swamp games with these people and nothing has happened. They're looking to "run out the clock". Then the country will explode.

    The fix is in by the obviously corrupt FISA court. How could they seriously think this clowns appointment would provide an honest and fair assessment of the equally corrupt FBI.
    It's a deliberate cover up of the wrong doing by the FBI and the Obama Justice Department. What Obama judges made this appointment?

    Swamp creatures will continue to exist. You will not like my comments. Your government is controlled by a foreign state. This state controls our foreign and monetary policies. The only way to get back our freedom is the abolition of the current system in favor of independent states. Thank you!

      Absolutely agree! Have been preaching similar for last couple of years. The huge pot of money we surrender to DC is too much temptation. Humans are flawed and imperfect. (Ever heard of the saintly parish secretary caught embezzling? ) This cannot be fixed by electing "correct" candidates (I don't believe the polls are honest anyway). Quick, direct solution is to keep most of the tax receipts in your own state, and send to DC only enough to support it's Constitutional duties. Money is power, and if the flow slows to a trickle, the Swamp will dry up very quickly, be on their knees! .STATES' RIGHTS!
      Obviously, this is somewhat tongue-in-cheek. I hope you can see the logic of us controlling OUR money, and thereby able to regain needed leverage. I'll ask you guys for ideas on how to execute this. Constitutional convention?

    I could cry. This is just chilling. It is clear that the most heinous creatures abide in Washington DC and our government's corruption will prevail long after DJT has left office. Even with the truth so obviously before us, the swamp dwellers will stay in business. I fear my beloved country is a lost cause

    Everyone please remember!! Chief Justice John Roberts is in charge of the FISA court!!
    Also remember, he is the one who rewrote Obamacare so it could be legal !!

    The unspoken question is, could the [FISA] court itself be corrupt? How else could so many "errors" have gone undetected and uncorrected? If not corrupt, then how about incompetent?

    I might be ok with Kris being appointed to liquidate all the assets and close the doors of this FISC forever. Anything more than that is blatant swamp promotion and a slap in the face to 63 million + American voters. If the swamp is counting on us not paying attention, I intend to work with my fellow citizens to make enough noise about this that they will hear us.
