I don’t know if it’s true, but I’ve heard that Chief Justice Roberts – in a rare show of spine – will refuse to preside over an unconstitutional impeachment trial of a former president. Since the Constitution explicitly declares that the Chief Justice will preside over an impeachment trial, if the Dems go ahead anyway, would that not put anyone who participates in this unconstitutional effort in serious legal jeopardy? I don’t know if it would quite rise to the level of insurrection or sedition, but it would be a blatant abuse of power in an effort to punish a political opponent. You can’t just set aside the Constitution when it gets in your way. An unconstitutional impeachment would be a “polite” equivalent of storming the Capitol building.
