(READ) Documents regarding procedures followed after Ashli Babbitt's homicide at Capitol riots

The watchdog group Judicial Watch has received more than a thousand pages of documents regarding Ashli Babbitt's homicide at the January 6 Capitol riots.

Babbit, who was white, was unarmed when she was shot and killed by a black Capitol Police lieutenant. Prosecutors declined to charge the officer and, like the Capitol Police Department, have withheld his name from the public and the press. Authorities have said they found no evidence that the officer did not reasonably believe his life was at risk.

According to JudicialWatch, these findings are contained in the documents:

  • Babbitt cause of death was determined by January 13.
  • The cause of death was withheld until April 7, well after President Trump's impeachment and exit from office.

Judicial Watch: New Documents reveal the Office of the Chief Medical Examiner Submitted a Request to Cremate Ashli Babbitt Two Days after Gaining Custody of Her Body

(Washington, DC) Judicial Watch announced today that it received 1160 pages of documents from Washington, DCโ€™s Office of the Chief Medical Examiner (OCME) related to Air Force veteran and San Diego native Ashli Babbitt. These new documents reveal that OCME submitted a request for permission to cremate Babbitt only two days after taking custody of her body and that โ€˜due to the โ€œhigh profile natureโ€ of Babbittโ€™s case, Deputy Chief Medical Examiner Francisco Diaz requested that a secure electronic file with limited access be created for Babbittโ€™s records.  

Additionally, Babbittโ€™s fingerprints were emailed to a person supposedly working for the DC government, which resulted in Microsoft โ€œundeliverableโ€ messages written in Chinese characters being returned.

Babbitt was shot and killed by an unidentified law enforcement officer as she attempted to climb through a broken interior window in the Capitol Building, located outside the Speakerโ€™s Lobby off the House Floor during the January 6 disturbance. She was unarmed. At the time of the shooting, several officers reportedly can be seen in videos, standing in the crowd of protestors in which Babbitt was present.

The records were obtained in response to a Freedom of Information Act (FOIA) lawsuit concerning two FOIA requests submitted by Judicial Watch on April 8, 2021 to the Metropolitan Police Department and the Office of the Chief Medical Examiner for records related to Babbittโ€™s death (Judicial Watch v. The District of Columbia (No. 2021 CA 001710 B)).

The newly obtained records reveal:

  • On January 8, 2021, at 7:13 p.m., an application to cremate the body of Babbitt is labeled โ€œcompleted successfully.โ€ Copies of the permit are sent to OCME officials Kimberli Hall and SaVern Fripp, as well as Melinda Smith, Jennifer Love, Lisa Tabron, Jeanette Belle, and Perlieshia Gales. 
  • In a January 6, 2021, email sent at 9:48 p.m. from OCME official Denise Lyles to medical examiner Francisco Diaz, the subject line is, โ€œCase #21-00106 ID Confirmed.โ€ [Case 21-00106 was Ashli Babbittโ€™s file number.]
  • On January 6, 2021, at 9:43 p.m., Lyles emails OCME official Dr. Jennifer Love an attachment with the message, โ€œI am updating the information we received from IAD [Internal Affairs Division] re the confirmed ID for OCME Case #21-00106 [Ashli Babbittโ€™s case]. These are the prints that returned from the FBI, that the detectives from IAD provided. I dropped them in the e-case file. Their names are noted below.โ€

Lyles appears to have forwarded the file after having received it at 9:33 p.m. on January 6 from someone (whose name is redacted) within the Prince Georgeโ€™s County, MD, Police Criminal Investigation Division, assigned to the โ€œHomicide Unit โ€“ FBI/Cross Border Task Force.โ€ The file had been sent to that person at 9:30 p.m. on January 6 from someone with the email addressย efcon@gmw00001.str0.ngi.cjis.

  • On January 6, 2021, at 7:42 p.m., OCME official Jamie Spann emailed a scanned file called โ€œ21-00106 FBI Submission Formโ€ to Grant Greenwalt, Manager of the Crime Scenes Sciences unit of the DC Department of Forensic Sciences, as well as someone with the email address spc@leo.gov, and copying medical examiners Francisco Diaz and Jennifer Love, asking, โ€œPlease run the attached prints.โ€ This document contained Ashli Babbittโ€™s fingerprints.

Greeenwalt forwards the request to David Chumbley, an officer of the DC Police Department. Chumbley forwards the prints on from his iPhone at 8:06 p.m. on January 6 to someone identified as Jamese Kororma within the DC government. The email sent to โ€œJamese Korormaโ€ resulted in multiple Microsoft โ€œundeliverableโ€ messages being returned, written in what appear to be Chinese characters. 

  • On January 7, 2021, Forensics photographer Matthew Brown emailed OCME colleagues regarding Babbittโ€™s case with โ€œHighโ€ importance,โ€ stating, โ€œDue to the high-profile nature of case 21-00106, Dr. Diaz has requested limited access to this case. Please create a secure folder on the photo server for case 21-00106 and provide access only to the following OCME staff: Dr. Mitchell, Dr. Diaz, Anna Francis, Matthew Brown.โ€

Brown adds, โ€œCurrently there are no images or folders on the photo server for this case. The images are being held on the OCME archiving server until a secure folder is created.โ€ 

Michael Coleman, OCMEโ€™s Chief Information Officer, responded two hours later, โ€œThe requested directory has been created with the stipulated access granted. Please let me know if any additional adjustments are required.โ€ 

Brown replies, โ€œThank you Mike. The case photos are now available on the server.โ€

Responding separately to Coleman, OCME Records Manager Anna Francis says, โ€œI have restricted the e-case file as well. For work purposes, the following groups have access, please let me know if permissions should be limited further: 1. Anna Francis; 2. MLI Investigations; 3. Medical Examiners; 4. Michael Coleman; 5. Roger Mitchell; 6. QC-n-RecMgmt; 7. Investigators.โ€

  • In a January 14, 2021, email from Deputy Chief Toxicologist Stephen Raso to OCME colleague Samantha Tolliver with the subject โ€œCapital Riot Cases,โ€ Raso states, โ€œSee attached prelim results.โ€
  • In a February 2, 2021, email from OCME official Andrea Pugh to medical examiner Dr. Francisco Diaz, Pugh indicated that the preliminary toxicology report on Babbitt was completed.
  • On January 13, 2021, Dr. Francisco Diaz emailed Chief Medical Examiner/Deputy Mayor Roger Mitchell with the note, โ€œ21-00106: COD-Gunshot wound to left anterior shoulder. MOD-Homicide.โ€ Note: COD is โ€œCause of Deathโ€ and MOD means โ€œManner of Death.โ€
  • The OCME did not release cause and manner of Babbittโ€™s death until April 7, 2021:

Ashli Babbitt, 35 years old:

Cause of Death - Gunshot wound to the left anterior shoulder

Manner of Death - Homicide

  • In a January 8, 2021, email, Lead Forensic Investigator Rebecca Wood tells OCME officials, โ€œI spoke with the family for the above case and her legal last name is โ€˜Babbitt.โ€™ CMS has been updated to reflect this change, please update the death certificate as well.โ€
  • In a January 8, 2021, email sent at 3:45 p.m., OCME official Denise Lyles messages her OCME colleagues with the subject โ€œCapitol Incident Cases,โ€ and notes โ€œFYI, all the cases from the Capitol Incident all Identifications have been confirmed,โ€ adding, โ€œAshli Elizabeth Pamatian aka A. Babbitt โ€“ partner/husband notified.โ€ 
  • The records include identification records for โ€œAshli Elizabeth Pamatian,โ€ including a copy of an FBI fingerprint submission card, a State Department visa check record โ€œfor identification purposes,โ€ and a separate FBI fingerprint submission card that indicated that the โ€œOfficial Taking Fingerprintsโ€ in the Babbitt case was โ€œE. Betts.โ€

Additionally, Babbittโ€™s body was listed as โ€œUnidentified femaleโ€ and โ€œWF.โ€

The DC government form included in the records states: โ€œThe District of Columbia Office of Chief Medical Examiner has recovered human remains and is requesting AFIS fingerprint database searches for identification purposes,โ€ and the โ€œtransaction typeโ€ on the form indicates โ€œUnidentified Deceased (DEU Transaction).

The comments section notes, โ€œPlease attempt to identify this unidentified female who was discovered deceased on 01/06/2021 in Washington, DC.โ€ The form asks the response to be faxed to OCME. official Jennifer Love. An X-ray log sheet indicates that three โ€œLODOXโ€ images of Babbittโ€™s body were taken by a technician with the initials RK.

  • In an email on January 18, 2021, Deputy Chief Medical Examiner Francisco Diaz sends an attachment with Babbittโ€™s case file number to OCME officials Kristina Giese and Kimberly Golden stating, โ€œPlease review this homicide.โ€
  • In an email on March 1, 2021, OCME official Cheryle Adams messaged colleagues Beverly Fields and Dr. Francisco Diaz (copying Mayorโ€™s office spokeswoman Olivia Dedner), advising them that she was providing an updated spreadsheet of reporters seeking information on the people who died at โ€œthe January 6, 2021, Insurrection at the Capitol.โ€ 

โ€œThere is intense public interest in the shooting of Ashli Babbitt at the Capitol on January 6,โ€ stated Judicial Watch President Tom Fitton. โ€œThe continued secrecy and delayed release of information about the shooting death of Ashli Babbitt are suspicious and smacks of politics. That Americans still have no information about who killed her or any police report about her death is a scandal of epic proportions.โ€

The Metropolitan Police Department has not yet responded to Judicial Watchโ€™s FOIA request. This document release is part of Judicial Watchโ€™s ongoing investigation into the January 6 disturbance.

In March, Judicial Watch filed a FOIA lawsuit against the District of Columbia for documents about the death of Capitol Police Officer Brian Sicknick. Pressure from this lawsuit helped lead to the disclosure that Capitol Police Officer Brian Sicknick died of natural causes.

Judicial Watch also filed lawsuits for U.S. Capitol Police emails and videoย related to the riotย and for Speaker Nancy Pelosiโ€™sย communicationsย with the Pentagon in the days after the January 6 incident.

    "....due to the high profile of this case....":
    - Babbit was cremated in 2 days time.
    - " Dr. Diaz has requested limited access to this case."

    In start contrast, George Floyd was not cremated in 2 days (official martyrdom precluded that) and there was NO LIMIT to access to the details of the case including disclosure of the name of the law enforcement officer that was involved in presumably causing his death.

    Obviously the Floyd situation was not high profile (or at least in the right direction).

    Makes sense to me. /sarc.

    Fairly common knowledge that the officer who murdered Ashki Babbitt was Lt Michael Leroy Byrd.

    "the family had "a lovely service" for Ashli anyway. When we scattered her ashes, I had them dedicated to patriotic people. They did a flag ceremony for her and taps was played for her and we honored her with respect" from Ashli's mom in Dโ€™Souza interview. So she was cremated and the ashes were given to the family but the when / how of the cremation remain unclear to me.

      No need to keep the body, there's video of how she was killed. No doubt about it, the bullet fired from the USCP officer's gun killed her.

    This entering into the Capitol was orchestrated by the left, imho.

    Ashli was MURDERED by that luitenant. Shot in the back of her shoulder.

    That cop needs to be fired and stand trial.

    It's sad to see and hear how Americans and America is being destroyed and NO ONE in positions of authority are doing anything to stop this madness. OBAMA., SOROS with other higher ups all over the World are rushing to establish a New World ORDER and everyone is looking for SOMEONE ANYONE TO STOP THIS . I ASK all that will listen GET ON YOUR KNEES AND ASK GOD TO FORGIVE AND SAVE YOU AND TO PLEASE FORGIVE AND HELP AMERICA. GOD IS OUR ONLY HOPE..THIS young ladies death should bring people to their senses that your life only matters to God and those who really love you. May God comfort her husband and parents and all who love her.

    Remember, she was entering a barricaded room/hallway thr0ugh a busted out window and had to climb up to enter it. And you can see someone on the other side with a pistol. Seems like she took a chance while trespassing and unfortunately lost her life. Why all the strange "cover-up" moves makes little sense.

      It was more of an ambush. The shooter remained concealed except for the one second e stepped forward to fire at close range and just as rapidly retreat.

    The officer's name is Michael Byrd. He had stated that he would not be touched due to his position with the Capital Police. I believe he is a Lt.

    The Democrats and their Social justice warriors do not care. They don't even care when a black person kills another unarmed black person (look at the daily killings in Chicago), so why would they care if a black man kills an unarmed woman. It doesn't fit their narrative.
