Family of Brian Terry reacts after 9th Circuit overturns murder conviction

More than 13 years after the murder of U.S. Border Patrol Agent Brian Terry, Terry’s family is still seeking justice, and the U.S.-Mexico border remains in crisis.

Late Friday, the 9th U.S. Circuit Court of Appeals overturned the conviction and life sentence of a man found guilty of killing Brian Terry in 2010.  Terry’s death exposed a botched federal gun operation known as “Fast and Furious,” and brought into focus the national border crisis. 

Brian Terry’s uncle Ralph Terry said, “In more than a decade so little has changed. Our fight to seek justice for Brian is ongoing, at the same time our border security has worsened. This toxic combination led to the death of my nephew and sadly lessons have not been learned. As our current political leaders have turn a blind eye to the situation, they have empowered smugglers and drug cartels more than ever.”

The court in vacating the convictions of Heraclio Osorio-Arellanes August 9th, claimed his constitutional due process rights had been violated, sending the case back to the U.S. District Court in Arizona.

The family of Brian Terry is deeply disappointed by the ruling but respects the rule of law and the federal prosecutors who have worked so hard to deliver justice. The family hopes prosecutors will refile the charges and again obtain a first-degree murder conviction. 

Michelle Terry-Balogh, Brian’s sister said, “Why are we still seeking justice for Brian and why is our border still in crisis after all these years? The massive amount of illegal immigration  continues to overwhelm the border patrol. During the 2016 presidential campaign, illegal immigration and border security became a major topic and primary concern by many Americans. Once again, the topic of border security should be discussed among our political leaders. Our family will work with any elected leader, regardless of political affiliation, who has the courage and a plan to secure the border. It won’t bring back Brian, but it may bring some meaning to such a senseless murder.”

The Brian Terry Foundation provides scholarships for those considering careers in law enforcement and raises money for the families of fallen Border Patrol agents.

Ralph Terry, who serves as the President of the Brian Terry Foundation added, “Brian died an American hero. He lost his life trying to make the border more secure. We need leadership to ensure his sacrifice was not in vain. The mistakes of our government leaders should be remembered and used to enhance overall border security today and in the future.”

Agent Brian Terry was shot and killed in 2010 while trying to apprehend members of a Mexican drug cartel rip crew near Rio Rico, Arizona. Two semi-automatic assault rifles found at the murder scene were traced to the botched gun trafficking investigation known as Operation Fast and Furious. The ATF allowed licensed firearms dealers to sell weapons to illegal straw buyers, to track the guns to Mexican drug cartels, but they lost track of the weapons.

In addition to providing scholarships and assisting families of fallen agents, over the years the foundation has also hosted the Brian Terry Courage Awards and Benefit Dinner. Previous speakers and honorees include former Congresswoman Gabrielle Giffords, reporter Sharyl Attkisson, former Congressman Ron Barber, Congressman Darrell Issa, Governor Doug Ducey, and U.S. Border Patrol Agent Eric Gough and ATF whistleblower John Dodson.

    If a USA government employee knowingly sold a firearm to a dope dealing cartel member for whatever reason, then that government employee committed a Federal Crime and should be prosecuted. The immunity question is moot when the sale of an illegal gun results in a dead Border Patrol Agent. This case smacks of a failed publicity stunt where the actors were playing to a future media hype that they themselves were in the process of creating. Anyone with half a brain can see this plan was flawed from the first moment. The USA Federal Government likes to be cute sometimes, and this case puts the failed cuteness on full display.

  2. Meanwhile protesters from the January six “insurrection” lie are in jail for decades for protesting against fascist oligarchical government.

  3. The Fast and Furious program was under BO”s presidency. The very Liberal 9th Circuit obviously didn’t want BO to be held responsible and also removed their hand print from the matter. ” You scrub my back, I’ll scrub yours”.

  4. The sad thing is when you elect brain dead presidents who know little about how their decisions may affect others. They seemly go blind eyes ahead because someone says its a good thing. It started with Obama and hasn’t stopped. In fact its gotten worse with a 50+ year do nothing Biden. I wish the American public would just get off their ash and start voting these lifers out of office. Put people in who really care.

  5. No mention of Eric Holder and his involvement in the Fast and Furious debacle!
    Did he approve it or not? If yes, when will he be arrested for involuntary manslaughter?

  6. It is almost unbelievable and it is tragic that morality has fallen so low in the USA, in my lifetime, that people have no problem voting for the democrat party no matter how deeply they sink. Some republicans are not much better while they call themselves conservative. Satan is alive and well.
