America First Legal (AFL) has filed a lawsuit on behalf of the Strong Communities Foundation of Arizona, known as “EZAZ.org,” against Arizona Secretary of State Adrian Fontes and his office for allegedly withholding a list of over 218,000 individuals who registered to vote without providing legally required proof of citizenship.
Secretary Fontes oversees Arizona’s statewide voter registration checks, which are intended to verify US citizenship, a requirement under Arizona law. On September 6, 2024, Maricopa County Recorder Stephen Richer identified a flaw in the system, revealing that tens of thousands had registered without providing proof of citizenship. Following this, on September 17, Richer filed an emergency petition with the Arizona Supreme Court to prevent the affected individuals from voting in state and local races.
In response, AFL filed a public records request on behalf of EZAZ.org, asking Secretary Fontes to produce the list of those who had registered without citizenship proof. Secretary Fontes denied the request, alleging that disclosing the information could lead to harassment, despite no evidence of such intent from EZAZ.org. Fontes further claimed the task was too burdensome for his staff—a claim AFL disputes, noting that the list was already compiled. AFL contends that withholding this information violates Arizona’s Public Records Law, which regularly grants public access to voter lists.

The lawsuit aims to compel Secretary Fontes to release the list to EZAZ.org and county recorders, enabling verification of citizenship status for these registrants.
