Judicial Watch announced it has filed a Freedom of Information Act (FOIA) lawsuit against the US Dept. of Homeland Security (DHS) for records of FEMA payments to New York City for migrant housing (Judicial Watch Inc. v. U.S. Department of Homeland Security (No. 1:25-cv-01579)).
The lawsuit follows FEMA’s failure to respond to a February 11, 2025, FOIA request seeking:
- Records of payments and funding allocations — including documents, invoices, receipts, contracts, and financial records showing FEMA payments to NYC or related entities under the Shelter and Services Program (SSP) from January 1, 2023, to the present.
- Any records indicating whether these funds were used for “hotels” or other accommodations.
- Internal communications and directives — such as emails, memos, or other written exchanges between FEMA officials, DHS leadership, and New York City officials about FEMA funds for migrant housing.
- Any internal communications discussing whether these payments complied with federal policies and regulations.
- Policy and procedural guidelines — including FEMA and DHS policies governing the SSP program, eligibility, approval processes, and financial oversight mechanisms.
In February, acting FEMA Administrator Cameron Hamilton reportedly suspended payments to NYC for migrant housing and stated that staff who authorized the payments would be held accountable.
Elon Musk wrote on X:
“We just discovered that FEMA sent $59M LAST WEEK to luxury hotels in New York City to house illegal migrants.”
Reports say four FEMA officials were fired over the incident—including the agency’s chief financial officer, two program analysts, and a grant specialist.
DHS Secretary Kristi Noem posted on X:
“I have clawed back the full payment that FEMA deep state activists unilaterally gave to NYC migrant hotels.”
“Taxpayer money was misused to fund hotel rooms for illegal alien invaders,” said Judicial Watch President Tom Fitton. “The Trump administration should prioritize transparency about this potentially illegal misuse of government funds.”
Earlier this year, Judicial Watch also sued Chicago Mayor Brandon Johnson for records tied to his vow to resist the Trump administration’s mass deportation and immigration enforcement efforts.

At least someone cares where our tax dollar goes. You would think those do nothings in congress or senate would have concerns about this. Then again its my tax dollar why would they even care?
I have a better idea. It was Biden, ON FIRST DAY IN OFFICE, who stopped border wall construction why? Simple, because DJT started it. Biden wanted a open border, doesn’t matter who came across. All criminals welcome.
Need money to house illegals? Trace down where and how Biden acquired millions. I’m betting illegally. Sue him, take it back then use HIS $$ to house them.

I wish Trump would make them more accountable. Post at Whitehouse.gov what they did and didn’t vote for that benefits or harms the American people. THAT would make a difference.
