A federal court has reopened a lawsuit filed by the family of 24-year-old George Watts Jr., a New York college student who died from vaccine-induced myocarditis shortly after receiving a mandated Covid vaccine.
Watts was attending SUNY Corning Community College in 2021 when the school required all students to receive the Covid vaccine. Concerned about the risks of unapproved shots, Watts waited until the Food and Drug Administration (FDA) gave full approval to Pfizer’s Comirnaty vaccine before getting vaccinated.
Four days after the FDA’s approval, Watts received his first dose. He was told it was the approved Comirnaty shot, but records show he was given the emergency use (EUA) Pfizer-BioNTech version instead — a vaccine never fully licensed.
After his second dose weeks later, Watts experienced neurological problems and a sinus infection. His health deteriorated, and on Oct. 27, 2021, he collapsed and died of cardiac arrest. The coroner ruled his death was caused by “complications of Covid-19 vaccine-related myocarditis.” His death certificate listed the vaccine as the sole immediate cause.
Watts’ family initially filed a claim through the federal Countermeasures Injury Compensation Program (CICP), which failed to respond within the required 240 days. That delay led them to file suit against the Department of Defense (DOD) and Defense Secretary Lloyd Austin.
The lawsuit — supported by watchdog group Children’s Health Defense — accuses the DOD of misleading the public by continuing to distribute only the unlicensed EUA shot, even after Comirnaty was approved. The suit claims this amounted to “willful misconduct” under the Public Readiness and Emergency Preparedness Act (PREP Act), which normally shields the government from liability during public health emergencies.
In 2024, a federal judge dismissed the lawsuit, citing sovereign immunity. But attorney Ray Flores, representing the Watts family, argued that the court failed to follow proper procedure under the PREP Act, which requires a three-judge panel to consider dismissal motions.
This month, that same judge reversed the earlier decision, admitting the court lacked jurisdiction to dismiss the case. A new three-judge panel will now decide whether the lawsuit can move forward.

Now perhaps, a three-judge panel will engage in fruitful discussions of the case’s intricacies amongst themselves and will issue a more detailed and favorable ruling.”

The outcome of this case could test the limits of government protection under the PREP Act — and whether families misled about the vaccine have any path to justice.
