A judge has denied an attempt by Kilmar Abrego Garcia’s attorneys to reopen his immigration case, leaving his final order of removal in place.
Abrego Garcia’s lawyers had filed an emergency motion in August, arguing that because he was deported to El Salvador and later brought back to the US, he should be allowed to apply for asylum within a year of his most recent entry.
But Regional Deputy Chief Immigration Judge Philip Taylor ruled the motion “untimely,” according to ABC News, since it was filed nearly six years after his original proceedings—well beyond the 90-day deadline.
Following the ruling, the Dept. of Homeland Security issued a statement on X declaring:
“With today’s ruling, Kilmar Abrego Garcia’s final order of removal stands.
This MS-13 gang member, human trafficker, domestic abuser, and child predator will never be loose on American streets.
His lawyers tried to fight his removal from the U.S. but one thing is certain, this Salvadoran man is not going to be able to remain in our country. He will never be allowed to prey on innocent Americans again.
Never forget the Democrats flew to a foreign land on the US taxpayer’s dime to break bread with this terrorist gang member and visit him in prison. While they continue to fight for criminal illegal aliens, we will continue to put the safety of the American people FIRST.”
With the court’s decision, Garcia will not be allowed to remain in the US.

Thanks, Phil, for providing the real story instead of whatever you’d want to call the article itself. Isn’t it almost amazing that someone (SA) who touts herself as “nonpartisan” and claims to be telling us all the truth would publish such a distorted story (things being stated as facts that have no evidence to support them, relevant information being left out) as this? But at least we have an entry for the next “media mistakes” article.
I kept hearing Homeland Security saying he is a member of MS-13 but never saw the proof. The photo of his knuckles is all I saw; obviously photo-shopped. And of the other three serious claims the domestic abuse was proven. His wife filed a complaint years ago and frankly it was her’s to forgive him.
Trafficking humans and child predator were both disproven.
And by the way, only one democrat congressman flew down on the tax payers dime to see him.
Noem just keeps exaggerating ICE’s successes. Get rid of the gangsters first as Trump promised.
