Attorneys in a federal fluoride lawsuit are accusing the Environmental Protection Agency (EPA) of trying to protect its own interests instead of the public’s health, as the agency appeals a judge’s ruling that it must address the health risks posed by water fluoridation.
The case, brought by Food & Water Watch and the Fluoride Action Network, centers around the Toxic Substances Control Act (TSCA), which allows citizens to petition the EPA to regulate dangerous chemicals. A federal judge previously ruled that fluoride in drinking water poses an “unreasonable risk” of neurodevelopmental harm to children.
But in its appeal, the EPA is not contesting the science. Instead, the agency argues the court shouldn’t have considered new evidence – including a multi-year study from the National Toxicology Program (NTP) – because it was published after the lawsuit was filed.

Attorneys say the EPA’s approach would prevent courts from ever considering the best available science when ruling on public health cases. They argue Congress created TSCA precisely to give citizens the right to force agency action when new dangers are discovered.
The brief also accuses the EPA of a “last-minute gambit” by raising new claims about one plaintiff’s standing — a Kansas mother who bought bottled water and filters to protect her child from fluoridated tap water. The EPA never challenged her standing during trial.

While the EPA once told the court to “let the science advance,” it is now objecting to the very studies it once cited. Oral arguments in the appeal are expected early next year.
More than 200 million Americans currently drink fluoridated water. Since the court ruling, over 60 towns, counties, and two states have voted to end water fluoridation.
