Citizens United: 10 years after a divisive Supreme Court ruling... and a new Clarence Thomas documentary

The famous Supreme Court case known as Citizens United has just passed it ten year anniversary.

Many say the decision opened the door for corporations to pour money into elections and campaigns drowning out the influence of individuals.

This week on Full Measure, we look at the surprising origins of the case and its impact today as we move into the heart of campaign 2020.

The conservative case was actually inspired by liberal documentary filmmaker Michael Moore, who was spending corporate money against Republicans under an exemption to the law at the time.

In speaking to representatives on both sides, one thing they agree on is that Citizens United has not had the impact many predicted.

Still it remains widely unpopular today.

We told you a few weeks ago about California wildfires sparked by one of the big utility companies there. Billions of tax dollars have been spent over the years fighting California’s wildfires.

Some critics say the emergency spending has taken away from the federally-funded fire prevention budget, making things only worse.

Now, a new money-saving fix is on the way. Lisa Fletcher takes us to California to Follow the Money.

And there's an eye-opening new documentary now in theatres about one of the quietest Supreme Court Justices: Clarence Thomas.

Slow VA payments leave veterans facing collection agencies

An internal investigation of the Department of Veterans Affairs (VA) has revealed a deeply flawed system. That's according to a report in the Wall Street Journal.

The investigation was prompted by a whistleblower inside the V.A.

One of the many problems reportedly identified in the investigation is that veterans' claims for medical treatment in the private sector often went unpaid.

After egregious backlogs in the V.A. system, Congress passed a law allowing vets to get treated by private doctors in certain cases.

But according to the Wall Street Journal, the V.A. was unable to keep up with the increasing number of claims from private care physicians, leaving many veterans' medical bills unpaid.

The unpaid bills often led to veterans facing a collection actions.

[The region] failed to timely reimburse community health-care providers, which resulted in some of those providers terminating services for veterans and referring veterans to collection agencies for nonpayment.

The investigation also allegedly found wasteful spending amounting to "hundreds of millions" of dollars.

The V.A. says it will continue to work to reduce the backlog in payments, but that claims are coming in at a greater rate than the V.A. can handle, according to the article.

POLL: State of the Union: Republicans more satisfied than Democrats

Republicans report satisfaction with 19 of 30 different aspects of the United States, while Democrats report satisfaction with only four, according to a recent Gallup poll.

Gallup's scorecard included features of the country's cultural, business, and government climates.

Both Republicans and Democrats report satisfaction with two broad features: the overall quality of life and the opportunity people have to get ahead by working hard, according to the poll.

Political affiliations mark diverging opinions on many other areas, such as the economy, healthcare, and the environment, according to Gallup.

Rep. Buck asks FBI's Wray for answers about Attkisson computer intrusion case

It's going on seven years since CBS News first announced the remote intrusions into my CBS computers.

With multiple independent forensic exams confirming the government's role in the surveillance, and with an admission from a former agent involved in the surveillance operation, the Justice Department is still protecting the guilty parties rather than hold them accountable.

Today, Rep. Ken Buck (R-Colorado) raised the controversy with FBI Director Christopher Wray at an oversight hearing before the House Judiciary Committee.

Congressman Ken Buck: Director Wray, For twenty-five years, I was a prosecutor. I have seen the professionalism of the men and women of the FBI firsthand. I know how hard-working, thorough, and honest FBI personnel are.

I am deeply concerned with revelations about the corrupt actions of the FBI leadership. I am particularly troubled with the FBI’s treatment of investigative journalists like Sharyl Attkisson. When the FBI spies on journalists, it undermines the public trust. It tarnishes the badge.

In early 2011, Sharyl Attkisson began reporting on Fast and Furious – where the Obama ATF recklessly allowed illegal gun sales and watched as straw purchasers “walked” guns across the Mexican border straight into the hands of drug cartels. Attkisson exposed this scandal and the fact that the illegal guns were found at several crime scenes, including where U.S. Border Patrol Agent Brian Terry was murdered.

For her work on Fast and Furious, Attkisson received an Edward R. Morrow award, an Emmy Award, and an Investigative Reporting Award.

Another Attkisson story involved Solyndra, a solar company involving an Obama donor. Obama Energy Secretary Chu approved more than half a billion dollars in taxpayer-backed loans to Solyndra. Chu ignored Treasury’s legal guidance and put the rights of private investors above taxpayer interests. When Solyndra went bankrupt, taxpayers lost $528 million. The Administration sought to delay Solyndra’s layoff announcement until after the 2010 election.

Ms. Attkisson also covered Obama’s Benghazi coverup. Thanks to her, we know Secretary of State Hillary Clinton ignored the warning signs. As allies were withdrawing from Libya, we did not. We know four Americans died waiting in vain for our government to send help. We know Susan Rice, Hillary Clinton, and Ben Rhodes then lied, blaming the attack on a video. Attkisson was nominated for an Emmy for her Benghazi reporting.

Director Wray, you and I are public officials. Media criticism comes with the territory. Some criticism may be unfair, but a free press is indispensable to democracy.

The stories that investigative journalists work on are important. The American people deserve to know the truth about their government, including with respect to Fast and Furious, Solyndra, and Benghazi.

Did the Obama Administration thank Sharyl Attkisson for her work? Did the White House recognize her for keeping the public informed and holding government accountable? Did President Obama present her with a Presidential Medal of Freedom? No, using a highly politicized FBI, the Administration spied on her. That’s what small-minded people do.

  • Government emails show the Obama White House plotted to silence her stories.
  • After suspicious incidents involving her home internet, computers and phones, Attkisson hired a forensic computer expert who determined she was hacked by an IP address used by the FBI to conduct domestic surveillance - and that spyware proprietary to the federal government and several classified files - had been inserted on her computer.
  • CBS News, Ms. Attkisson’s employer, undertook a second forensic exam, confirming those conclusions.
  • Former government officials, including one from the FBI, later admitted they took part in this illegal surveillance.

When confronted with the facts, Attkisson did what a good investigative journalist does – she sought the truth. As a last resort, she sued DOJ and the FBI in search of justice. Did the FBI come clean and admit what happened? No, they engaged in delay tactics, prompting Federal Judge James Wynn, an Obama appointee, to write a scathing rebuke of the government’s conduct.

I am short on time, so I will forward to your office several written questions for a response.

  1. Has any employee working at or for the FBI ever obtained any record concerning Sharyl Attkisson, James Rosen, AP Reporters Matt Apuzzo, Adam Goldman, Kimberly Dozier, Eileen Sullivan, or Alan Fram or AP Editor Ted Bridis and shared that record with anyone in the Obama White House, including for purposes of creating or maintaining an enemies list?
  2. Has any employee, contractor or other representative of DOJ, to include the FBI, ever attempted to remove, exfiltrate, or transfer data to or from any electronic device used by Sharyl Attkisson, James Rosen or anyone with the AP previously mentioned, without that individual’s consent?
  3. In each instance where you answered “yes” to a prior question, please identify under what legal authority such actions took place.

Director Wray, the FBI must put restrictions in place to prevent an Administration, regardless of party, from using the FBI for political purposes.

Given how politicized the FBI and intelligence community have become, I will not support an effort in Congress to renew the expiring provisions of FISA unless and until the FBI and national security agencies clean up their act.

"Just Trump" most influences voters in 2020

The biggest single factor influencing voters as we move into the 2020 presidential campaign is: Trump himself.

That's according to the latest unscientific poll at SharylAttkisson.com.

Thirty-two percent (32%) of respondents say "Just Trump" will most influence their 2020 vote.

That's followed by the economy at 29% and immigration at 20%.

For first time, Navy will name aircraft carrier after African-American

The Navy recently announced it will name a future Gerald R. Ford-class aircraft carrier in honor of Third Class Doris Miller.

This will be the second Navy ship named after Miller, but the first aircraft carrier ever named for an African-American or in honor of an enlisted sailor's actions.

Miller was the ship's cook on the battleship West Virginia stationed in Hawaii in 1941.

According to the Navy, he manned a .50 caliber Browning anti-aircraft machine gun until he ran out of ammunition and helped move many other injured sailors during the attack on Pearl Harbor on December 7, 1941.

Miller later died in the line of duty when the USS Liscome Bay was hit by a torpedo and sank in 1943.

Doris Miller stood for everything that is good about our nation, and his story deserves to be remembered and repeated wherever our people continue the watch today.

The Trump impeachment bump

  • Registered voters favoring a second term for Trump is up from 41% to 50%
  • Trump's job approval, foreign affairs and trade numbers hit their record highs
  • Trump's approval on economy is highest of any president in more than 18 years
  • Majority favor finding Trump not guilty of impeachment charges
  • Republican favorability jumps 8 percentage points and is highest since 2005
  • More Americans now identify as Republican than Democrat

Impeachment, Schmimpeachment.

President Trump's job approval rating has risen to 49%, according to Gallup. It is the highest ranking of his presidency in the poll.

His previous best number was 46%.

The rise in the most recent approval rating is due to better marks among Republicans and independents.

Trump also busted the ceiling on the economy with the best economic approval rating of any president since late 2001. His ratings on foreign affairs and trade are also the best of his presidency. Favorability of the Republican Party is at its highest since 2005. And more Americans now identify themselves as Republican ore Republican-leaning.

Breaking down the job approval numbers:

Republican approval of Trump: 94%, up 6 from early January.

Independents' approval of Trump: 42%, up 5.

Democrat approval of Trump: 7%, down 3.

The poll showing good news for Trump was conducted January 16 through 29, in the middle of the Senate impeachment trial.

Gallup found 52% of Americans favor finding Trump not guilty of impeachment charges. Forty-six percent (46%) favor convicting Trump and removing him from office.

Economy

Sixty-three percent (63%) say they approve of Trump's handling of the economy. That's up 6 from November and "the highest economic approval rating not only for Trump, but for any president since George W. Bush enjoyed stratospheric job approval ratings in the first few months after the Sept. 11, 2001, terrorist attacks."

Foreign

According to Gallup, Trump is at his best numbers for handling foreign affairs (47%) and trade (50%).

Republican and Democrat Parties

For the first time since 2005, Republican favorability has surpassed 50%.

Fifty-one percent (51%) of Americans view the Republican Party favorably, according to Gallup. That's up 8 from September.

Slightly less, 45% of Americans, have a positive opinion of the Democrat Party. That's down 3 from September.

Gallup finds 48% of Americans identifying as Republicans or Republican-leaning compared to 44% who said they are Democrats or Democrat-leaning. That's a flip from the Democrat party advantage for much of last year.

Among registered voters, 50% favor a second term for Trump. That is up 9 from where the number stood just before the 2018 midterm elections (41%).

According to Gallup, Gallup President Clinton received a similar boost after he was impeached:

  • Clinton's approval rating spiked to a personal high of 73% after the House impeachment vote, and stayed above his pre-impeachment readings through his acquittal by the Senate in early 1999.
  • A seven-point average Democratic advantage in party identification and leaning in two early December 1998 polls (49% to 42%) swelled to an average 17 points (53% to 36%) in two late December polls after the Dec. 19, 1998, impeachment vote.
  • The latest impeachment saga has had a different effect on party favorable ratings, however. When Clinton was impeached, favorable ratings of the Democratic Party were unchanged (but high, at 57% and 58% in two December polls), while the GOP's ratings plummeted, falling from 43% pre-impeachment to an all-time low of 31% after the House vote to impeach.
