The U.S. Department of Justice sued Oklahoma on Tuesday over a state law that seeks to impose criminal penalties on those living in the state illegally.
The lawsuit in federal court in Oklahoma City challenges an Oklahoma law that makes it a state crime — punishable by up to two years in prison — to live in the state without legal immigration status.
Similar laws passed in Texas and Iowa already are facing challenges from the Justice Department.
Oklahoma is among several GOP states jockeying to push deeper into immigration enforcement as both Republicans and Democrats seize on the issue. Other bills targeting migrants have been passed this year in Florida, Georgia and Tennessee.
The Justice Department says the Oklahoma law violates the U.S. Constitution and is asking the court to declare it invalid and bar the state from enforcing it.
“Oklahoma cannot disregard the U.S. Constitution and settled Supreme Court precedent,” U.S. Principal Deputy Assistant Attorney General Brian M. Boynton, head of the Justice Department’s Civil Division, said in a statement. “We have brought this action to ensure that Oklahoma adheres to the Constitution and the framework adopted by Congress for regulation of immigration.” Oklahoma Gov. Kevin Stitt said the bill was necessary because the Biden administration is failing to secure the nation’s borders.
“Not only that, but they stand in the way of states trying to protect their citizens,” Stitt said in a statement.
The federal action was expected, as the Department of Justice warned Oklahoma officials last week that the agency would sue unless the state agreed not to enforce the new law.
In response, Drummond called the DOJ’s preemption argument “dubious at best” and said that while the federal government has broad authority over immigration, it does not have “exclusive power” on the subject.
“Oklahoma is exercising its concurrent and complementary power as a sovereign state to address an ongoing public crisis within its borders through appropriate legislation,” Drummond wrote in a letter to the DOJ. “Put more bluntly, Oklahoma is cleaning up the Biden Administration’s mess through entirely legal means in its own backyard – and will resolutely continue to do so by supplementing federal prohibitions with robust state penalties.”

Two years in prison for illegal residents sounds good, but a better idea might be to give them a choice of two years in prison OR voluntarily returning to their country of origin, with a bonus of 4 years in prison if they go home and then illegally return to the US.
They need to be fingerprinted and DNA sample taken before deportation. We need to make sure they don’t sneak back in (and they do) and make up a new name.
This is coming from Garland, the corrupt weasel, who thinks he can push Oklahoma around. The Sheriffs in OK should arrest every federal officer in the entire State and escort them to the border and kick them out. And tell Biden to pound sand. These A holes have done NOTHING to protect this country from outright invasion.

These are dystopian times in which we live and this is merely more evidence of that fact. The DOJ and Homeland Security do not do their job enforcing the law so the states step in to do it for them, then the DOJ goes after the states? The fundamental duty, and some would argue ONLY duty, of the federal government is to protect America from outsiders and from each other. With Democrats in the Whitehouse and Senate, they have failed spectacularly in that duty, seemingly on purpose.
So one has to ask, why is the DOJ doing this? Aren’t illegal aliens, illegal lawbreakers? Oh I see, the dem marxists need new voters since blacks have had it with them.
They are here illegally! Our constitution affords them no rights because they are not our citizens! I would posit , that the leftist umong us are also not our citizens. They were transplanted here generations ago to destroy our just laws and in turn , our country. Unfortunately, it’s working on the indoctrinated younger generations. Our Republic was set up for a just society. Other cultures from around the world will not and do not fit our model of governance. They don’t assimilate, nore do they want to assimilate into our culture. They want to ,as Obama said, fundamentaly change our nation to what and where they came from. They hate our guts and everything we stand for. Why our leaders would work to destroy this country is beyond my comprehension. It is something that i truly do not understand. Like I said, most of our so called elected leaders are corrupt liars and money whores, that would sell their own mothers for money. Everything that comes out of their mouths on their campaign trails is a bald face lie. We all know this and yet we still relect instead of rejecting them.

ONLY a corrupt and tyrannical government would NOT have a problem allowing ILLEGALS to come through our borders, rob us of OUR hard earned tax dollars which SHOULD be used for WE THE PEOPLE!!!
I wish our “representatives” would champion the interests of American citizens instead of being our adversaries by clawing more and more of our tax dollars and resources away from us to benefit illegal aliens! Lucky for us, Trump understands!
