(READ) Rep. Ken Buck addresses concerns with new surveillance act passed by House Judiciary Committee


Today, Congressman Ken Buck (R-Colorado) released a letter he sent to colleagues in the U.S. House of Representatives Monday, highlighting issues with the Protect Liberty and End Warrantless Surveillance Act (PLEWSA) and explaining his support for the FISA Reform and Reauthorization Act of 2023 (FRRA).

“At a time when American hostages are currently being held by Hamas, hackers in Russia are accessing U.S. healthcare databases, and Chinese nationals are stealing military secrets – to name only a few escalating threats – the House Judiciary Committee has passed the Protect Liberty and End Warrantless Surveillance Act (PLEWSA), a FISA reform bill that hampers U.S. surveillance capabilities, severely undermining the United States’ ability to thwart potential terrorist attacks,” Rep. Buck wrote to his colleagues in the Monday letter. 

The letter continues: “As Members of Congress, our goal in reforming FISA should be to protect U.S. citizens from foreign threats, while simultaneously protecting the privacy interests of those same citizens. Our Constitution allows for such a balance, and we should take this twofold challenge seriously. HPSCI’s FISA reform bill, the FISA Reform and Reauthorization Act of 2023, strikes precisely the right balance, while the Judiciary Committee bill, PLEWSA, places unneeded restrictions on law enforcement and the intelligence community, while extending new rights to foreign terrorists, cartel members, and spies.”

“To be clear, Americans’ rights are in no way elevated when known terrorists, cartel members, and spies are granted new legal loopholes and mechanisms to delay warrants and surveillance.” 

“I urge you to support FRRA, as a proper balance between safety and privacy. Please feel free to reach out to my office with any questions about these bills. I look forward to working with each of you to reauthorize this vital program and protect American citizens, while also upholding the Constitution’s safeguards on individual liberty.”

The letter explicitly outlines three areas of primary concern with PLEWSA.

  1. LOL — Is this the SAME Ken Buck who is NOT running for reelection in 2024 and is the ONLY republican expected to vote against a formal impeachment inquiry this week?

    I wonder how much he can make by selling out between now and when his term expires.

  3. I agree with balance…what is the “balance” when federal agencies abuse their authority and use the power of 720 on citizens? There is a long string of abuse spanning many years and all citizens get is an apology and a promise of better behave…that has yet to materialize. There needs to be some sort of accountability for those actions because clearly apologies don’t cut it and don’t deter abuse. What is the Senator’s proposal to create that balance?

  5. It is my understanding that surveillance of Foreign Nationals does not require any FISA warrant, only when a US citizen is to be surveilled must the government obtain a FISA warrant. That being true, EVERY precaution and measure must be taken to ensure a Citizen’s right to privacy is protected.
    It appears to me that Rep Buck is ignoring the distiction between who can be monitored as he begins with Hamas hostages, Russian hacking of healthcare and Chinese theft of military secrets.
    The abuses by the FBI being reported are not the surveillance of Hamas, Russia, China or other foreign agents. Such surveillance requires no FISA warrant.
